The <u><a href=\"https:\/\/c212.net\/c\/link\/?t=0&amp;l=en&amp;o=3044344-1&amp;h=3991508379&amp;u=https%3A%2F%2Fchildrenshealthdefense.org%2Fwp-content%2Fuploads%2FCorrected-Brief-and-Hyperlinks-Table-Postable-pdf-A1.pdf&amp;a=appeal\" target=\"_blank\" rel=\"nofollow noopener\">appeal<\/a><\/u>\u00a0seeks to have the court order the FCC to remand, vacate and update its 25-year-old exposure guidelines for radio-frequency radiation (RFR) from cellphones, cell towers, Wi-Fi, 5G and other wireless communication devices.<\/span><\/span><\/div>\n<div id=\"asset-content\" data-smart-adunit=\"\/132916964\/cen\" data-asset-uuid=\"1f3aa89b-9c87-5579-9745-8de196f8caaf\">\n<div class=\"row\">\n<div class=\"col-lg-12 col-md-12 col-sm-12\" data-subscription-required-class=\"col-xs-12\">\n<div class=\"asset-body\" data-subscription-required-class=\"asset-body\">\n<div class=\"asset-content  subscriber-premium\">\n<div class=\"xn-content\">\n<p><span class=\"colour\"><span class=\"size\">Arguments in the case will be <u><a href=\"https:\/\/c212.net\/c\/link\/?t=0&amp;l=en&amp;o=3044344-1&amp;h=3486619722&amp;u=http%3A%2F%2Fwww.youtube.com%2Fuscourtscadc&amp;a=livestreamed\" target=\"_blank\" rel=\"nofollow noopener\">livestreamed<\/a><\/u>\u00a0via audio. The presiding three-judge panel in the U.S. Court of Appeals for the <span class=\"xn-location\">District of Columbia<\/span> includes the Honorable Karen Henderson, <span class=\"xn-person\">Patricia Millett<\/span> and <span class=\"xn-person\">Robert Wilkins<\/span>.<\/span><\/span><\/p>\n<p><span class=\"colour\"><span class=\"size\">The court ordered that one attorney present the case for all the Petitioners allocating 10 minutes each for the Petitioners and the FCC.\u00a0EHT and CHD have agreed to have CHD&#8217;s attorney, <span class=\"xn-person\">Scott McCullough<\/span>, former Assistant Texas Attorney General and telecom attorney, to present the Petitioners&#8217; joint argument. Robert F Kennedy, Jr., CHD&#8217;s Chairman, is the organization&#8217;s co-counsel.\u00a0<\/span><\/span><\/p>\n<p><span class=\"colour\"><span class=\"size\">EHT is represented by attorney <span class=\"xn-person\">Edward B. Myers<\/span>, who intervened in the<u><a href=\"https:\/\/c212.net\/c\/link\/?t=0&amp;l=en&amp;o=3044344-1&amp;h=1623704806&amp;u=https%3A%2F%2Fehtrust.org%2Fwp-content%2Fuploads%2FCourt-Opinion.pdf&amp;a=%C2%A0successful+case\" target=\"_blank\" rel=\"nofollow noopener\">\u00a0successful case<\/a>\u00a0<\/u>of the Natural Resources Defense Council (NRDC) and several Native American Tribes when<u><a href=\"https:\/\/c212.net\/c\/link\/?t=0&amp;l=en&amp;o=3044344-1&amp;h=1080556079&amp;u=https%3A%2F%2Fehtrust.org%2Ffederal-court-overturns-fcc-order-which-bypassed-environmental-review-for-5g-small-cell-wireless%2F&amp;a=%C2%A0the+court+upheld\" target=\"_blank\" rel=\"nofollow noopener\">\u00a0the court upheld<\/a><\/u> the relevance of the National Environmental Policy Act (NEPA) in FCC&#8217;s\u00a0 5G proceedings. The NRDC filed an <u><a href=\"https:\/\/c212.net\/c\/link\/?t=0&amp;l=en&amp;o=3044344-1&amp;h=3754282756&amp;u=https%3A%2F%2Fchildrenshealthdefense.org%2Fwp-content%2Fuploads%2Fnrdc-amicus-8-5-20.pdf&amp;a=amicus+brief\" target=\"_blank\" rel=\"nofollow noopener\">amicus brief<\/a><\/u>\u00a0in the Petitioners&#8217; case.<\/span><\/span><\/p>\n<p><span class=\"colour\"><span class=\"size\">The Petitioners contend the FCC ignored extensive evidence submitted to the agency showing that non-thermal levels of pulsed and modulated RFR emitted by wireless technology are harmful to humans, wildlife and the environment, and its order failed to provide a record of a reasoned decision making. Therefore, the Petitioners claim the FCC has violated the Administrative Procedure Act (APA), and its decision is capricious, arbitrary and not evidence-based. In addition, the Petitioners argue that the FCC violated NEPA because the Agency failed to consider the environmental impacts of its decision.\u00a0It also violated the 1996 Telecommunications Act (TCA) because it failed to consider the impact of its decision on public health and safety.<\/span><\/span><\/p>\n<p><span class=\"colour\"><span class=\"size\">The FCC ignored numerous submissions detailing injuries and rapidly growing illnesses such as Radiation Sickness from radiofrequency radiation. Petitioners argued that the inadequate FCC guidelines are used to deny accommodation in violation of the Americans with Disabilities Act.
