{"id":19021,"date":"2022-09-27T21:51:42","date_gmt":"2022-09-28T04:51:42","guid":{"rendered":"https:\/\/emrabc.ca\/?p=19021"},"modified":"2023-02-03T21:52:53","modified_gmt":"2023-02-04T04:52:53","slug":"phonegate-canada-court-authorizes-class-action-against-apple-and-samsung","status":"publish","type":"post","link":"https:\/\/emrabc.ca\/?p=19021","title":{"rendered":"Phonegate Canada: Court Authorizes Class Action Against Apple And Samsung"},"content":{"rendered":"<p>September 27, 2022<\/p>\n<p><strong>In a judgement \u2013 <a href=\"https:\/\/stopsmartmetersbc.com\/wp-content\/uploads\/2022\/09\/Quebec-Class-Action-Judgement-500-06-001018-197-Tracey-Arial-et-al-v.-Apple-Canada-Inc.Apple-Inc.-and-Samsung-Electronics-CanadaSamsung-Electronics-Co.-Ltd.-Sept.22-2022.pdf\">https:\/\/stopsmartmetersbc.com\/wp-content\/uploads\/2022\/09\/Quebec-Class-Action-Judgement-500-06-001018-197-Tracey-Arial-et-al-v.-Apple-Canada-Inc.Apple-Inc.-and-Samsung-Electronics-CanadaSamsung-Electronics-Co.-Ltd.-Sept.22-2022.pdf<\/a> \u2013 rendered on September 22, 2022, the seven plaintiffs, Tracey Ariel, Claire O\u2019Brien, Erika Patton, Zoe Patton, Alex Tasciyan, Mathew Nucciarone and Vito Decicco, have been given a win by Judge Christian Immer.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 They will therefore be allowed to launch a class action against the manufacturers of Apple and Samsung smartphones, in the context of the Phonegate scandal.<\/strong><\/p>\n<p>The action had been initiated in September 2019 by <strong>Attorney Charles O Brien<\/strong>, following the <a href=\"https:\/\/phonegatealert.org\/en\/press-release-revelation-of-the-chicago-tribune-on-the-tests-of-the-most-popular-cell-phones-in-the-united-states\/\"><strong>revelations<\/strong><\/a> in August 2019 of <strong>American journalist<\/strong> (and 2008 Pulitzer Prize winner) <strong>Sam Roe<\/strong> in the <strong><em>Chicago Tribune<\/em><\/strong>.<\/p>\n<p><span class=\"embed-youtube\"><iframe loading=\"lazy\" class=\"youtube-player\" src=\"https:\/\/www.youtube.com\/embed\/QfUUnxucif8?version=3&amp;rel=1&amp;showsearch=0&amp;showinfo=1&amp;iv_load_policy=1&amp;fs=1&amp;hl=en-US&amp;autohide=2&amp;start=36&amp;wmode=transparent\" width=\"474\" height=\"267\" sandbox=\"allow-scripts allow-same-origin allow-popups allow-presentation\" allowfullscreen=\"allowfullscreen\" data-mce-fragment=\"1\"><\/iframe><\/span><\/p>\n<p>(video 10:08) <a href=\"https:\/\/www.youtube.com\/watch?v=QfUUnxucif8&amp;t=36s\"><strong>https:\/\/www.youtube.com\/watch?v=QfUUnxucif8&amp;t=36s<\/strong><\/a><\/p>\n<p>Just recently (end of August 2022), in the U.S. Phonegate case, a <a href=\"https:\/\/phonegatealert.org\/en\/phonegate-usa-apple-iphones-win-a-legal-battle\/\"><strong>ruling<\/strong><\/a> did not hold the giant <a href=\"https:\/\/www.apple.com\/ca\/\"><strong>Apple<\/strong><\/a> accountable for the overexposure of users of its <a href=\"https:\/\/en.wikipedia.org\/wiki\/IPhone\"><strong>iPhones<\/strong><\/a>.<\/p>\n<h3><strong>Phonegate could cost Apple and Samsung dearl<\/strong>y<\/h3>\n<p>The Canadian decision also authorizes a claim for damages against <strong>Apple Canada, Apple Inc., <\/strong><a href=\"https:\/\/www.samsung.com\/ca\/\"><strong>Samsung Electronics Canada<\/strong><\/a><strong> and Samsung Electronics Co.
