{"id":6838,"date":"2015-07-14T15:31:59","date_gmt":"2015-07-14T22:31:59","guid":{"rendered":"https:\/\/emrabc.ca\/?p=6838"},"modified":"2015-07-14T15:31:59","modified_gmt":"2015-07-14T22:31:59","slug":"california-victory-in-16-month-standoff-as-psrec-drops-fees-and-restores-electric-service","status":"publish","type":"post","link":"https:\/\/emrabc.ca\/?p=6838","title":{"rendered":"California Victory in 16-month Standoff as PSREC Drops Fees and Restores Electric Service"},"content":{"rendered":"<p>Posted on\u00a0<a title=\"10:39 am\" href=\"http:\/\/stopsmartmeters.org\/2015\/07\/06\/victory-in-16-month-standoff-as-psrec-drops-fees-and-restores-electric-service\/\" rel=\"bookmark\">July 6, 2015<\/a>\u00a0by\u00a0<a title=\"View all posts by onthelevelblog\" href=\"http:\/\/stopsmartmeters.org\/author\/onthelevelblog\/\">onthelevelblog<\/a><\/p>\n<p>At the appeal court hearing on June 29th, after it was revealed that Superior Court Judge Ira Kaufman has a no-cost self-read analog meter at his home, and after PSREC\u2019s legal arguments defending their \u201copt out\u201d program fell apart, the utility\u2019s General Manager Bob Marshall agreed to reconnect our electricity, drop all past fees and provide self-read analog service at no charge.<\/p>\n<p><strong>Electricity was restored at our home on Thursday afternoon, and the analog meter remains in place.<\/strong><\/p>\n<p>Thank you to our attorney Michael Jackson, and everyone who has supported us and kept us going through our 16-month stand. It has not always been easy.\u00a0 However, when push comes to shove, it is clear that utility company bullying just does not stand up in court.<\/p>\n<p><strong>In the end, PSREC did not want medical experts testifying about the health hazards of their smart meters.\u00a0<\/strong>\u00a0Their desire to \u201chave their cake and eat it too\u201d significantly undermined their case.\u00a0 For example, they claimed their AMR meters were not \u201c<em>smart meters<\/em>\u201d but then insisted that the recent CPUC\u00a0<em>smart meter<\/em>\u00a0decision justified their ability to charge residents fees for avoiding them.\u00a0 They proclaimed their independence\u2013as a cooperative\u2013from CPUC regulations, but then leaned heavily on the CPUC\u2019s December opt out decision\u2013limited to the four main investor owned utilities in California, to justify the legality of those fees.<\/p>\n<p>The takeaway?
